The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. That's roughly the typical weekly usage we saw last year and if the pace doesn't change much, the cap will potentially be hit one to two months later than for FY2011. H1B would be difficult as that requires 4 year college degree.
But she is eligible for MS depending on requirements of programs, let her research schools and their programs.

If I apply for H1b in April, 2008 and choose consular visa processing, and the H1b starts in Oct, 2008. Do I have to go to the consular for a H1b visa? I might receive a EAD from 485 before October, and if I do, I would like to use EAD but keep the option of H1b open.
Can anyone answer me???
Say I don't activate my H1b in Oct 2008, but H1b is valid for three years, does it mean I can activate it any time by going to the consular for a H1b visa from 10/2008 to 09/2011? Of course I will keep my status valid (AOS) throughout the period.

Hi,
Gurus - I have few questions and I need your help:
1. My EAD/AP expires in June/July '08. Can I apply for their renewal now?
2. Will there be a finger-printing requirement for the renewal? We had finger print in June 2007 when we applied 485/765/131 together?
3. Is it better to efile or paper file?
4. I will be in India from April to June this year. I have an AP valid till end June. Can I file for EAD/AP renewal and leave for India in April. Is there any risk? I can still use my current AP to enter when I come in early June, right?

Hi,
I was an employee with company A till march 2008 and i kept a H1b transfer to
company B on march 24th 2008. I was working to company B for an year
on receipt number applied for h1b transfer at USCIS. I got an RFE with
company B in sept 2008 mean while my I-94 got expired on August 2008.
Company B answered the RFE and submitted to USCIS on October 2008.
After waiting for H1B transfer to get approved it got denied on march 10th
2009.
Now i wanted to change my status from H1b to F1(CPT). My questions are
1. If i apply for transfer from H1B to F1 will i be getting New I-94 from
USCIS?
2. Should i be going back to india for getting stamped after i change my
status to F1 ?
3. Can i be on a student status from the day i receive the receipt notice
from USCIS for change of status ?

I applied under the EB1 B at the NSC in January 2010. A month later received an RFE challenging all 6 criteria. The RFE acknowledged some of my work. I sent in more evidence in April. After 2 months of no reply - I opened a SR. Then a month later, I received an RFE again. It was the same RFE with only the date changed. There was no acknowledgemnt of the additional paperwork sent in response to the first RFE.
Any thoughts on how I should proceed.

ABC News has an interesting piece that discusses the birth tourism controversy and quotes a statistic that actually comes from Lindsey Graham's office. According to the National Center of Health Statistics, just 7,760 mothers report that they live outside the US of more than 4,000,000 births each year. Keep in mind that some of these mothers are actually US citizens who reside abroad but want to have their children in the US. So we're really talking about less than .2% of all births as being this huge problem that suddenly justifies overturning the 14th Amendment.

Depends on the validity of the VISA. For example, if a person has 10 year multi entry (M) VISA, that person can enter whenever he/she wants.
For limited time frame, say 6 months validity, there should be a validity on the VISA itself, person needs to enter in that particular time frame.

I asked my attorney if we could anything about the delay in the issuance of EAD. My attorney mentioned that she would send an e-mail to USCIS. Is there an e-mail id that attorneys use to contact USCIS ? Offcourse, I could have asked my attorney, but I thought I would post the question here first.

My cousin who came here on H4, found a company that sponsored her H1-b and she was working as a consultant to a big firm. She had to return to home country last year, and she had to get her papers stamped - which was denied.
