My sister is in US in Visitor Visa with I-94 expiration date of Nov 25th 2009. We would like to convert her status from B2 to F1 Visa ASAP.
1) Do you know anyone who has changed the status from B2 and F1? If yes, can you share the experience?
2) Is it risky to do that? What kinds of problem we may encounter?
3) Can she stay in US while F1 is pending? what happens if rejection shows up after her current i-94 expiration date?
4) Is it better to go home country and apply for the F1 Visa or it is safer to change the the status in US.
Any advise you can throw will be appreciated.

I am in my 5th yr of H1, and my H1 status will expire next year on Nov 1, 2011.
My I140 filed and is with the appeal Office since jan 2009, with no decision.
I wanted to know what my options are with the current scenario.
� What are the chances of this appeal being approved? ( it was denied based on 5 yrs of education vs 6 years)
� If the appeal is denied, can I transfer the Labor to an EB3, with the same Priority Date?
� Since there is no decision yet, do I have to file another Labor cert ( a new one) for H1 extension.
� How can I still maintain this priority date?
� If I have to file a new Labor cert, can that be done in EB2,with a different job title?

I recently got an RFE for my I 485 Application.
Need to prove my non-immigration status from Nov 29 2007 to Nov 24 2008 .
I have I-797 ( H1-B approval ) for the above mentioned period. But My Last Name in the approval has a typo error ( in place of letter A they misstyped U). My Enployer has opened a Service request to correct the Name in H1 B approval. But he is saying that he never got the corrected approval. Time went by and i applied for H1 ext..i got the H1 extension from Nov 25 2008 to Nov 2011.
So My question is
Is it okay to submit all the documention that was sent to USCIS to correct the name along with the I 797,I-94 for the above mentioned period and explain them that we did not recieved the corrected I-797 ? or not
Please suggest me ..

Hi,
Could one of the lawyers/expert please provide their opinion on my situation?
In 2004, my H1B extension was denied and later on approved in Nunc Pro Tunc. The nunc pro tunc process took a total of 64 days and when approved my I-94 was NOT back dated. Hence, I do not have I-94 for 64 days. Later on in July 2007, I filed for my I485.
Since my approval, I have not traveled outside the country and I am currently on EAD based on my pending 485.
The question I have, it's bothering me a lot, Will the gap in I94 for 64 days cause any problems in my I485 approval?
Please advise.

I have applied for my PERM Labor Certification on Aug, 6th'07. My status online shows "IN PROCESS". DOL called my employer's contact to verify submission on Aug, 15th'07.
My Lawyer states that rather than preparing for I-140 / I-485. I would be best served in working on preparing a response to the audit that will be coming, because of the Spanish language requirement.
Is he just getting ready for a "just-in-case" audit...? Should I prepare the I-140 and deal with the audit on the 30-days if DOL sends the Audit letter? How long would it take to receive this letter?

Also I have planned to move to a different State after I apply for Citizenship.
