I got laid off from Company A in Jan.2009 but I filed transfer for my H1-B to Company B based on receipt notice which I have for Company A. but Just now I came to know from USCIS that Transfer which I filed for Company A in Oct.2008 has RFE and Company A denied to answer RFE cos I am no longer their employee.
Question:
1. Can I get a receipt notice for Company B ?
2. Is there really an Issue for my Transfer to company B due to RFE in previous filing?

Visitor's visa for my parents expired recently (it was a 5 yr VISA & they visited here 3 times and returned within 6 months each time) and they want to re-apply for a visa. My question is - Do I still need to send in the Document of Support, Employer and Bank letter or they can re-apply without these documents? On the safer side, I am sending the documents but in my view there should not be a need for the support documents...Anyone in similar boat?

Another more circuitous method if you want to make the entire object transparent is to import the movie into a movie clip inside Flash. You can use Flash's Alpha slider to adjust the alpha of the movie clip and adjust the quality that way.

You should get to talk to USCIS coz this is wrong for sure......USCIS should issue you a new EAD with no additional cost.........Even if you do not plan to use EAD card get the issue fixed.......

Hi all,
My ETA case in online status shows "DATA REVIEW" for the past 5 months, my PD Aug 04/RIR/EB2 is with Dallas BPEC.Initially the status was closed, and then opened. After 5 months of reopening it still says 'Data review' .Is there some thing wrong or should I talk to my lawyer.
Some of my friends who applied that time have their status 'in process' or even 'certified' .Any experience like this or will that go to certified from here directly or to "in process" first. How long it can be in each of these statuses.
Any ideas appreciated please!

My parents I94 is expiring on March 27th 2008.
We had filed for extension (form I 539) in California Service Centre with receipt date of Jan 02 2008.
Calif is currently processing Oct 2007 I529s.
My concerns are :
1) I think their stay here is legal till we hear back from USCIS on their extension. Please confirm if this is true.
2) If they get declined , they have to leave immediately. Is that period of stay considered illegal?
3) Is overstaying with legal extension an issue if they need to come again after 6 months or so? What is the criteria they look for for frequency of visits/stay periods at port of entry.
Will greatly appreciat all your personal experiences /wise opinion on this matter of pressing concern for us.

Hi,
I have been granted an asylum last year in July. I sent my I-485 to adjust my status this year on August 24th with the fee waiver form (sending proof of food stamp eligibility and supporting documents.)
Today is October 2nd(its been almost 40 days) and I have not received a document receipt from USCIS (we are a family of 3 and non of us has received anything in regards to this matter)
Please let me know what actions should I take or should i wait?! Is it possible to not get a receipt and just receive the finger print notice in the next few months?! (I just checked texas service center's processing times, and it says they are at March 28th,2010 now)

I have recently obtained 3 years of H1B extension because my I-140 is approved and priority date is not current.
Soon after, I interviewed and managed to land multiple offers....! Got totally frustrated on the job front and waiting for PD to be current.
Questions:
1. Can I apply for multiple transfers at the same time?
2. Is PD portable, assuming employer doesn't withdraw I-140?
3. If I lose PD, can labor app be filed for me by the new company, say 6 months from now?
In general, I'm very concerned and would appreciate any help. If you know of good immigration lawyers, available for consultation, pls direct me to the website.

We have been applying for advance parole document at NSC for the last few years.
This time we sent our application to NSC on 01/28/2010.
After about 15 days, we received a receipt notice letter from Vermont service center.
The I-131 application instructions specify that I-140 based applications should be sent to either Nebraska or Texas service centers.
I am wondering if USCIS started processing I-131 application in VSC.
Or our application is mistakenly misclassified and sent to VSC.
Any comments?

I have a question regarding the H1 / H4 status of my spouse.
My spouse entered US in 2006 on H4 visa (valid till 2008 ). In 2007 she applied for H1B and the I 797 start date is October 2007. She did not apply for any status adjustment (from H4 to H1). She did apply for SSN using the EAD and presently not working.
I just wanted to know, what is her visa status now. Is it H4 or H1?

i m new to this forum. I know that when I-485 pending and EAD pending for 90 days, u can get temporary EAD from local USCIS office.
in similar way, can u also get temporary AP (advanced parole) if application pending for 90 days.

I am trying to analyse the impact based on 245i. Based on it
PIC countries benefited from unused visas a lot till now to have their PD current/move up. So based on that benefit, Also one thing is clear the unused visas if available are country indepedent and are used at the rate of 27% per quarter.
so for example 100K visas are available (which i would enjoy having )27K per quarter is available from the start of the year . Now among this 27K how is the distribution, can it be distributed whichever applicant needs PD IRRESPECTIVE of EB1,EB2,EB3(skilled, professional) Vs EB3 other or does it split by the calculations of EB1, EB2, EB3 with 28% EACH and EB3 other NOT above 10K limit

In above link, how is it possible to have pending I-485 (EB2) for 2008 & 2009 for India? If i remember correctly the priority date for India has reached upto Jul 2007 only so far.
