From its passage in 2002 until now, the USCIS has never issued so much as a memo explaining how it interprets the "automatic conversion" clause of the Child Status Protection Act (CSPA). my current employer filed for my labor in march 2005, got approved in march 2007, filed I-140 in April 2005,and while I-140 was pending filed I-485 in july fiasco. In sep-2007 got intent to deny of I-140 based on A2P(ability to pay), employer filed M.T.R in October 2007. I have my fingered crossed looking at the financial statment from employer for the year 2005. chances are the MTR will be denied too. Now I have a new job offer from another employer who is willing to do new H1b for me and may be a labor petition too. the question is I want to see what comes out of the current MTR. Here is the question;
1/- if I tell the current employer to contine the process(which I dont think he will have problem with) and join the job on h1b will my I-485 status be changed or will it effects the current process?
2/- I am currently runnig on sixth year of h1b and my current visa expires in 2010 bades on the pending process with current employer. if I join the new employer on h1b what will be the H1b status will be?

I have two I - 140s pending (say A and B)
I am applying I-485 for A (140)
If my I-140 for A gets denied can I change the I-485 to use I 140 from B later?
Or do I need to apply for I-485 freshly with I-140 from B?

I went for Fingerprinting for I-485 case seond time on 9th May. When it is updated in your profile at uscis website. I see it is still showing up old dates as LUD.
Any idea ?
I gave my Fingerprints also. So far i did not see any LUD. I dont know what they are doing. Simply ignore it. There is nothing to do ourside.

Article says "On June 12, 2008, U.S. Citizenship and Immigration Services (USCIS) informed the American Immigration Lawyers Association that the H-1B random selection process has been completed. USCIS completed the intake and receipt processes for all filings as of May 24, 2008 and began mailing rejection notices the week of June 9. Therefore, if an employer has not yet received a filing confirmation (Form I-797C Notice of Action), it likely means that the petition was not selected in the random process and that the rejection notice will be forthcoming."

I am applying my Labor on EB2 tomorrow (07/26/2007). Is there any glim chacne for me to get the approval before 08/14/2007? I am going through Atlanta. Please let me know how long is the average time to get the cetification from atlanta center. (One of my friend applied on 07/17/07 and got the LC on 07/23/07 from atlanta center).

I gave first FP on 9/28 and lat month I took info pass and the officer raised a SR for non delivery of cards to which I got a reply that my card might have lost in mail. I called USCIS who mentioned that my card was never created and now it will be created. Now my online status changes mentioning that I have been sent FP notice again. I called uscis again and mentioned that I already gave biometrics
The officer said it was erroneous so ignore the FP notice and he will be requesting CPO for me. I even called FBI FP line today to confirm that my first FP was fine and they said it was fine and uploaded

This is bad news about July visa bulletin being changed. I'm sorry for everybody who had bad news.
I think maybe it is bad news for me too.
I was waiting for interview letter, my PD is March 2006 but I am going thru consular processing. I have I140 approved since February 2006.
I have 'case complete' and was waiting for packet 4.
I don't know what this all means for me now.

If we want to find out whether USCIS will accept our applications, we have to prove that Visa #s were available on a particular day. This thread will track the 485 approvals received on or after June 28th.
