Hello,
I 'm on H1-B visa already max out and got the extension for 7 th year based on perm pending.
Petition is going to expire in Sep 2011 and last week my perm got denied.
My employer is going to appeal for the perm and also going to apply H1B extension.
Also I got an offer from other employer waited long time for this exiting offer. Not sure what are my options now , is it possible to take the new opportunity or should I stick with my current employer to deal with this issue?
Looking for suggestions ASAP , thanks

Dear experts/Attorneys,
Please help me. My EB2 priority date in 21Nov 2007. My I 140 is approved and yet to file for I 485. Now at work I have promotion offer from Sr developer to Team lead. Technologies I work for won't change, but I have to change my work location to different state in this case
do I have to file for PERM and I 140 again?
If I have to file 140 can I retain priority date?
Is there any other option for me to escape PERM refiling other than not accepting promotion :)?
Your advice is greatly appreciated.

I just spoke with Xiyun Yang from Washington Post and conveyed thanks for covering a detailed article. She expressed that there is attention being drawn by many quarters including political for "Skilled LEGAL Immigrants".
Also we need to emphasize & communicate is the "increased fees" (almost doubled in many cases) for all USCIS services effective end of this month (July 30). Is this the penalty to be legal ?
The rallys and campaigns should emphasize this important detail too. This is huge money and not fair to the amount of service that is being currently provided.

This is not really a revelation as visa fraud has been a problem for decades at US consulates around the world. But it reminds us that there are bad actors out there and US consular officials have a tough job in trying to make sure that deserving applicants get visas while they ferret out the fraudsters. The $500 anti-fraud fee that accompanies every H-1B petition is supposed to help provide the funding to properly investigate and root out fraud. It sounds like the system is working.

I have a pending I- 485 in EB2 and My spouse has a pending 485 in EB3 since 2007. We both are using EAD and on AOS. We got married recently, and my PD became current now.
What is the best way to make use of this situation and add my spouse to my pending 485?
Do we have to file another fresh I - 485 or is there a way to link his EB3 485 application with mine?
If I have to file a new 485, what are the documents needed apart from Marriage certificate, Since my spouse is already on EAD and working, Do I still have to send affidavit of support, my pay slips, w2, EVL etc.? Do we have to send medicals again? Kindly clarify my questions. Help is appreciated.

HI,
My wife is going to India and She has to get her H4 stamped again(I am on H1 and received my next 3 year extension and so did my wife).
My parents are also planing to visit me. Should I book my wife's appointment along with my parent's appointment , or should I book 2 different appointments one for my wife and one for both my parents.

New numbers are out on H-1B usage and the past week showed last week's substantial pickup was just noise. Only 800 visas were claimed against the 65,000 cap, half of last week's total and somewhat less than the typical weekly usage we've seen over the summer. 37,400 H-1Bs have been counted now. I'm moving my exhaustion projection date back a week. My target is based on a rolling four week usage average so variations from week to week are discounted.
