Lots of activity to report. Congressional Hispanic Caucus leaders met this week with President Obama who said he wants a vote during the Lame Duck and would work the phones to round up votes. Harry Reid tweeted today that he'll offer the DREAM Act as a standalone bill which will hopefully help bring along a few of the "procedural" no voters from last September who indicated they like the DREAM Act but didn't believe in tacking it on to a budget bill. Hi
I am in H1B visa (valid until 10/2011), my wife is in F1 student (valid until 8/2011). We just got married 1 month ago in US. currently, we are staying in US. Now, she would like to stop studying for some reasons. To keep her valid stay in US, I have to transfer her f1 to h4. Could you please let me know step by step what I should do, what form I should take…etc.
Does she need any visa interview after filing the transferring f1 to H4?
Can she inform the school that she will stop studying right after filing visa transferring? (the school will stop her f1 if they know that).

Congratulations IV!! We have reached the 4000 member mark. While this is definetly a milestone, like TO_BE_OR_NOT_TO_BE and ragz4u pointed out, we have a lot more potential...
Now that being said, there is a difference between 'giving' vs 'taking'.. In the last couple of weeks we have had 100's of people register to become members, and yet whenever IV volunteers ask for contribution, less that 1% of the new people come to contribute.. That is a TAKER mentality..

Folks, While a contribution of a 100$ is not a big deal, even if we contribute 50$ (to start with) and 50% of the 2800 people contribute we would have an additional $70,000. This should not be a big deal..

Ten weeks into the new Congress, it is clear that revelation, not legislation, is going to be its real product.
While President Bush threatens to use his veto pen to stop some bills and Senate Republicans block other measures from even reaching his desk, no force in Washington can halt the Democrats' investigative juggernaut from uncovering the secrets inside this administration.
For the first six years of the Bush administration, these aides were allowed free rein to carry out whatever policy or political assignments they wished -- or supposed that the president wanted done. A Congress under firm Republican control was somnolent when it came to oversight of the executive branch. No Republican committee chairman wanted to turn over rocks in a Republican administration.
You have to feel a twinge of sympathy now for the Bush appointees who suddenly find unsympathetic Democratic chairmen such as Henry Waxman, John Conyers, Patrick Leahy and Carl Levin investigating their cases. Even if those appointees are scrupulously careful about their actions now, who knows what subpoenaed memos and e-mails in their files will reveal about the past?
They will pay the price for the temporary breakdown in the system of checks and balances that occurred between 2001 and this year -- when the Republican Congress forgot its responsibility to hold the executive branch accountable.
It was a fundamental dereliction of duty by Congress, and it probably did more to encourage bad decisions and harmful actions by executive-branch political appointees than the much-touted lobbying influence. In reality, many Republican members of Congress did not mind what was happening because they were able to get favors done in that permissive climate. Now, the Democratic investigators will publicize instances of influence by members of Congress, and the political fallout will not stop with New Mexico's Pete Domenici and Heather Wilson.
Democrats find it easier to investigate than to legislate. With their major initiatives, from a minimum-wage boost to a shutdown of the Iraq war, stymied by Republican opposition, the Democrats are understandably making "accountability" their new goal -- meaning more and more investigations.
Fulfilling that promise, later in the week the House passed a series of bills that stripped some of the secrecy from executive branch documents and decisions.
Accountability is certainly important, but Democrats must know that people were really voting for action on Iraq, health care, immigration, energy and a few other problems. Investigations are useful, but only legislation on big issues changes lives.

Hi,
I am Vijay Vellabati, finished MS in Dec-06 and I got a job in Jul.
I am in my OPT(Optional Practical training). I did not get to file for my H1-B.
Can my company apply for Green card for me right now.
Because I need to keep my status, my OPT expires in Dec-07.
If anyone can get back to me, I would appreciate that.

Yes, green card is for future employment, your employer can apply for your greencard!!
But usually the greencard process takes so long that it is nearly impossible to get it in a year (the time you have in OPT) so the safe bet is to apply h1b otherwise in US-Masters quota if you have one. And take it from there.

Please guide me in my situation.
I am on OPT right now which is valid thru May 2008. I have already applied for H1 through Company A in April this year. I got a job offer from Company B recently. I would like to join Company B and start working for it on my OPT. Company A failed to provide job for me so I wish to transfer my H1 (once after it is approved) to Company B. Now I have the following questions:
1. What happens to my OPT after I get approved for H1 through Company A?
2. Do I have to stop working for Company B as soon as I get my H1?
3. Can I transfer the H1 I get for Company A to Company B without any paystubs?
4. Can I refuse the H1 and continue to work for Company B on my OPT and then apply for fresh H1 in 2008?
5. Is there any possibility for Company A to cancel my status and make me go back to India?
Please help. I am totally lost and confused.....:confused:

I140 is pending, Filed EB2 485 on Jul2nd, no receipt yet, and we don't know when it will come.
My wife's F1 is going to expire on Aug28. I was planning to file COS to H4 for her now. However, today I heard that filing AOS and COS at the same time will be a conflict and one case might get denied.
Should I still go ahead and file her COS now or wait some more time till we get the 485 receipt? The concern I have is that AOS is not a safe status since 140 is still pending now. However we don't want to mess up 485 just because of the COS application.
Can anyone give me some suggestion on this situation? Hope this is the right place to post the question.

No. You must already have 485 pending, or you should be applying 765 along with your 485 concurrently. However to apply for 485, your PD must be current.
I got my labor and 140 cleared few months back under EB3, Can I apply for 765 to get my EAD ?
I have not applied for 485.
Please let me know.
