While we all sit and wait in this painful 485 retrogression, I am just wondering, what if the retrogression pulls on past the 3 year extension (attained after the initial 6 years and I140 approval).
I have my perm LC/I140 approved/485 retrogressed with a PD of Feb 2006.
Being EB2 and starting my 7/8/9 years in early 2007, I am a bit unlikely to hit that scenerio, but someone like me in EB3 is very likely to hit that scenerio...
Does anyone know, what happens after 9 years on H1 and not able to file 485 due to retrogression??

Guys I missed the conference call , But interested to know what happened &
if some key decisions made.
Called IV, But the person who answered was busy answering similar questions from other member.We don't want to waste precious time of IV leaders by calling indvidualy.
If someone who attended can summarize for the benifit of those who missed, It would be great.
Also does members of other nationalities(non Indians) also attended the conference call.. Hopefully IV is striving to become voice of all EB GC aspirants. Everyone will gain from joint effort and IV will have resources to do meaningful things.

As of April 15, 2010, approximately 13,600 H-1B cap (http://www.h1b.biz/lawyer-attorney-1137085.html)-subject petitions had been filed. USCIS has approved 5,800 H-1B petitions for aliens with advanced degrees.
Many immigration lawyers are seeing a sharp decline in the interest in the H1B visa this year by potential employers and workers. Some are saying that the downturn in H1B applications this year could be as much as 60%. As a result of this decline, there are predictions that the quota will not be reached within the first few months of this year. Rather, many suspect that the bachelor's quota won't be reached until the middle of July, and that the master's quota won't be reached until later this June.
We shall see how the number will play out in the next few months.

so. But since your 140 is approved the PD is yours. You have to find new employer, start from Labor process again.

Hi, me and my wife we both r on H1b. My wife works with a solution & service LLC.say company A, now the owner is ready to start a new company, say B,with my wife as partner. She will be just passive investor in the company and getting profits, if any from company B. Can she still work full time with company A?. How can we invest in company B and take profits. is there any problem is getting profits more then 500K in a year.
What r IRS forms?. Finally any good attorney suggestions for Houston, TX.
What are the options for business formation,
Does anyone see any issue with this kind of formation and GC process for me..

Company A applied for labor(EB2) in Dec2006. It was approved.
My I140 was filed in March 2007 and approved on Jan 10 2008.
I did not file for I485 in July 2007.
I had changed companies in April 2007.Presenly I am on Company B payroll.
Now, If I move back to Company A, would I be able to apply for my I485 when the date opens.
The online status for I140 says, Approved.
I am in good terms with both the employers.
If I move to company A; at the time of applying I485, do I need to have paystubs from Company A?
Please help. Thanks

I was on F1 visa and applied for my GC / I485 thru my spouse few years back. Unfortunately while coming back from India 3 years back, I used my stamped F1 visa instead of AP. My lawyer told me that due to this, I have abondoned my AOS and he has to withdraw my 485 and refile it when it will be current. Few days back spouse became current and attorney was preparing to apply for 485 again but in USCIS the status of my application was still shown pending not withdrawn. To our surprise, we saw 2 GC in the mail and the online status was shown approved. But the attorney is saying that we should re-file the 485 since USCIS did not withdraw my application and approved it. They says that I might have issues if my absence is detected when I will apply for citizenship later. Please suggest. I am so puzzled and tensed..

Just go to "edit photo" and you should be able to copy an image from an album to the monthly challenge.
How do I post to the monthly contest and keep the pictures in my albums? If I copy the images it posts them again in the "today's photos". Is there a way to post to just your album without them going to "today's photos"?
