With this mejob workload of I-140 filiing in next 2 months, I-140 procesing times will again retrogress.
so, can we change jobs even after 6 months of I-485 submission ??
Is I-140 approval required for AC21

I have 3yrs degree(Microbiology) and one year postgraduation diploma in computer science and 9years of work experience, Can I apply on EB2, some peolple saying at I-140 stage it gets problemetic with your degree, my employer says you can eligible to apply on EB2, Iam in real dilama, can any one please help me... thanks
I tend to think that your I140 in EB2 will be a problem. Specially so if your filing center is Nebraska. They have a reputation to be very very strict. Ask your employer if he has previously approved cases for people with your background.

Hi,
I was on H4 and had applied for H1B in 2008. After long processing and being pending for a long time it finally got approved in July 2009.
My question is, does my H1B start from oct 2008 or oct 2009? Can someone reply me on this.
Thanks

Can you use your spouse's cross-chargeability after you have filed for your I-140 already?
How time consuming is this for the USCIS to acknowledge?
Does spouse also need to have a GC application filed at that time or if your spouse is from a non-retrogressed country but not working then you can use her also?

I have my H1 visa interview in Vancouver, Canada on the 21st of Nov. I'll be driving from Hillsboro (OR) to Vancouver on the 20th evening. I also have hotel reservation very close to the US embassy.
I was wondering if anyone who has an interview on the same day might be interested in sharing the ride and/or hotel expenses. Since the 22nd is a holiday, and I need to stay back for another day to get the visa, I have the hotel room booked from the 20th through the 23rd.
Please let me know if you are interested, we'll discuss further.

Effective July 6, 2009, U.S. Citizenship and Immigration Services (USCIS) issued an interim rule amending the Department of Homeland Security (DHS) regulations with the intention to:
· end confusion by removing certain obsolete references to the Immigration and Naturalization Service (INS);
· help the public determine the correct place to file USCIS forms; and
· create a more efficient and streamlined process for any future changes to filing processes.

The concept of separation of powers, and of "checks and balances", is as old as Ancient Greece and the Roman Republic. Our Founding Fathers modeled the U.S. Constitution on principles derived from Enlightenment philosophers like Montesquieu who believed that "the judiciary was generally seen as the most important of powers, independent and unchecked..." He specified that "the independence of the judiciary has to be real, and not apparent merely." Unfortunately, in a stunning departure from such principles, under a law enacted in 1996, "discretionary" decisions of the USCIS and the BIA cannot be reviewed by the Federal Courts. And because...

May of you may be familiar with Professor Vivek Wadhwa from his columns in BusinessWeek and his major papers published on skilled worker immigration. I got to meet Professor Wadhwa when we both spoke at an ImmigrationWorksUSA conference a few months back. He gave a very informative presentation using the slides I'm attaching. Professor Wadhwa kindly agreed to let me publish them on my blog so readers could benefit. Many thanks Professor Wadhwa. Wadhwa presentation

AFAIK you do not need any documents as far as you have an onward connecting flight out of
Dubai. It is very simple. You do not need to worry about anything.

Visa, immigration laws have grown more complex | courierpostonline.com | Courier-Post (http://www.courierpostonline.com/article/20100928/NEWS05/100928046/Visa-immigration-laws-have-grown-more-complex)
"You're never going to have enough legal immigration slots for everybody who wants to come here," said Ira Mehlman, a spokesman for the Washington-based Federation for American Immigration Reform.
For the legal immigrants who do make it to this country, they are kept in waiting for years together with no sight of relief
The real troublemakers, said ALIPAC's Gheen, are employers who hire illegal immigrants, politicians who praise their contributions and authorities who make them feel welcome by, for example, offering forms and services in Spanish.
This never gets highlighted either by media or public. Many of these employers are big time contributors to the candidates - and candidates turned lawmakers offer their loyal protection! Unless, this changes, the problem cannot be really solved

My 140 was filed for a future Team lead position. I am currently a Sr Sw Engg with the same employer. The job description is nearly the same. But I am not sure how this little quirk effects my AC21 eligibility. When does my 180 day start counting ? From filing date or from the date I get the Team lead title ?

One think people don't get is, whether the current/future job qualify for EB2, It doesn't matter even you have a Phd and the job only requires Bachelor or equivalent then it is EB3, also certain programming jobs doesn't qualify for EB2. First ask your HR for min job requirement!:(
I have bachelors degree in law and 7 years human resource training development manager. Could I apply for eb2?

Hi All,
My wife is currently working on H1B. She recently got her EAD through my GC application (I am the primary applicant). Can she use her EAD to work for her current company who is holding H1B?
Appreciate your response immediately
Thanks in Advance
yes, just fill out a new I-9, this time indicating that you are going to use your EAD.
